FREMAP Contigo Terms and Conditions

• These Specific Terms and Conditions of Use govern the rules on the use of the FREMAP Contigo application, through which FREMAP, Mutual Society Partnering with Social Security No. 61, provides workers that are or have been covered by FREMAP with medical, financial and administrative information on their own processes, as well as other relevant services such as the activation of personal alerts or communication with your Social Worker Contact or with the people assigned to you.
• The User must read and accept these Specific Terms and Conditions of Use in order to be able to use all the services and obtain the information provided from the website.
• Only workers who fill in the required identification data on the website (workers who have at one time previously been identified at a FREMAP centre) and receive the access code to their mobile phone or email address may access FREMAP Contigo. Receipt of the access code grants the worker the status of User. The website indicates the steps to follow in order to gain access.
• The FREMAP Contigo User must have a computer or mobile device with an internet connection in order to access the service, with no obligation on FREMAP to provide, maintain or repair it, or provide technical support of any kind.
• The FREMAP Contigo User assumes all responsibility in terms of the data provided voluntarily for their registration and regarding the use they make of the login credentials (username and password), which are personal and untransferable and must be kept under the strictest confidentiality and safeguards.
• Access to FREMAP Contigo will be by means of an access password, which will be sent to the User via SMS. The User may change their username or password to enter the service at any time and must notify FREMAP if they observe any unauthorised use in their user account.
• For the proper provision of the service, FREMAP reserves the right to record and monitor the accesses made by Users.
• The information obtained by the User through this service, as well as the use, transmission or communication of the information, shall be the sole responsibility of the User.
• FREMAP reserves the right to modify or suspend this service, without this giving rise to any claim whatsoever.
• The User expressly undertakes:
  • To personally access this information with his/her username and password.
  • Not to disclose the username or password to third parties.
  • Not to assign or transfer to any third party, the rights acquired through the registration and acceptance of these conditions, or allow, for any reason or circumstance, their use by third parties, with any consequences arising from such assignment or transfer being the sole responsibility of the user.

  • For its part, FREMAP undertakes to adopt the technical and organisational measures necessary to guarantee the security of the personal data it receives from the User, preventing its alteration, loss, unauthorised processing or access.

• The User shall be liable to FREMAP for any culpable or negligent actions or omissions directly attributable to them regarding compliance with the obligations set out in these conditions and by the legislation applicable to the same, and in particular, those imposed and determined by Regulation (EU) 2016/679, General Data Protection Regulation and Organic Law 3/2018, of 5 December on the Protection of Personal Data and Guarantee of Digital Rights, when non-compliance gives rise to damages, penalties, fines and other amounts arising or deriving from any claim, including sanctioning procedures initiated by the Spanish Data Protection Agency in which FREMAP may be involved.
• The User may terminate the use of the service at any time and with immediate effect. For its part, FREMAP shall terminate the service in the event of breach by the User of these general conditions of use, without prejudice to any claim made for damages caused to the Mutual Society.
• Personal Data Protection. In accordance with the provisions of Article 13 of the General Data Protection Regulation (EU) 2016/679, we inform you of the following:

  Data Controller of the registered User's personal data.

  The Data Controller of the User's data is FREMAP, Mutual Society Partnering with Social Security No. 61, with registered address at Carretera de Pozuelo 61, 28222 Majadahonda (Madrid).

  The Data Protection Officer is the person in charge of safeguarding your privacy at our company. If you need to contact the Mutual Society, you can do so at dpd@fremap.es, or through a letter sent to the address provided in the previous paragraph, including the reference "Data Protection Area".

  Data categories that may be subject to processing.

  The personal data that may be processed will be identification and contact data, professional and health data in medical reports, medical discharges and medical leave, reports of occupational accidents and work-related illnesses and financial data corresponding to the benefits requested.

  Purpose of processing and data retention periods.

  The purpose of collecting and processing the User's data is to manage requests for access to the FREMAP Contigo application, which is made available to workers who are or have been covered by FREMAP, to facilitate access to information on their own processes, as well as other relevant services related to them, and the processing is based on compliance with a legal obligation attributed to the Data Controller and on the mutual legitimate interest of the Parties (Article 6.1 (c) and (f) and Article 9.2 (a) GDPR).

  The personal data processed will be kept for as long as the User is registered and during the legally established data retention periods, as well as for the limitation period for any actions that may arise from the data processing carried out.

  Legal basis for the processing of personal data.

  The legal basis for the processing of personal data is compliance with a legal obligation attributable to FREMAP as the data controller, such as providing access to personal data. Furthermore, in the mutual legitimate interest of the Parties, such as FREMAP providing a fast and simple telematic service to workers who are or have been covered by the Mutual Society and providing the User with access to information of a personal nature, the processing therefore being in accordance with the provisions of Articles 6.1 (c) and (f) and Article 9.2 (b) of Regulation (EU) 2016/679, General Personal Data Protection.

  Obligation to provide your data. Why are you obliged or not obliged to provide your data?

  The User must provide their data when requesting access to the application, failing which access cannot be managed and therefore no personal information or access to relevant services can be provided.

  Disclosure of personal data to third parties.

  No data will be disclosed to third parties unless required for compliance with legal obligations or you expressly consent to such disclosures.

  Exercising rights.

  The FREMAP CONTIGO User may exercise their data protection rights recognised under Regulation (EU) 2016/679, General Protection of Personal Data, and Organic Law 3/2018, of 5 December, on Personal Data Protection and Guaranteeing Digital Rights. Specifically, the rights are as follows:

  Right of access: The right to obtain confirmation as to whether FREMAP, Mutual Society Partnering with Social Security No. 61, is processing personal data that concerns you and, if it is, to be able to access this data.

  Right of rectification: The right to request that your data be amended or corrected if it is inaccurate.

  Right of erasure: The right to request that your data be erased or deleted due to having been unlawfully processed, because the reason for collecting or processing it no longer exists, if you revoke your consent or object to it being processed or when it must be deleted to comply with a legal obligation.

  Right of opposition: The right to object, at any time, for reasons related to your specific situation, to the processing of personal data that concerns you on the grounds of public interest or the legitimate interest of the data controller or a third party.

  Right of limitation of the processing: The right to restrict the processing of your data, if you contest its accuracy, if it is being processed unlawfully, if your personal data is no longer needed for the purpose it was originally being processed for, or if you have exercised your right to object to the processing of your data.

  Right of portability of the data: The right to receive the personal data that concerns you in a structured, commonly-used format that can be digitally read, and to transmit it to another data controller, provided it is technically possible.

  The right not to be subject to individual automated decisions: The right to object to being the subject of decisions solely based on the automated processing of personal data, including creating profiles, when this decision may legally or significantly affect you.

  The User may exercise these rights in writing, together with a copy of a document accrediting their identity, addressed to the Data Protection Officer at the email address derechos_arco@fremap.es or the postal address, Carretera de Pozuelo nº 61, 28222, Majadahonda (Madrid). The request can also be made at any FREMAP centre.

  Furthermore, the User may withdraw his/her consent and file a claim with the Data Protection Officer, as indicated above, or with the Spanish Data Protection Agency.

  Origin of your data.

  The personal data processed for the management of access to FREMAP CONTIGO is obtained directly from the User when he/she provides such data on the website form. Data may also come from General Treasury of the National Social Security Institute and from companies and consultancies that manage human resources, when these complete the healthcare request form in the event of work-related injuries and other cases envisaged by law.

• Industrial & Intellectual Property. All contents, trademarks, logos, drawings, documentation, computer programs or any other element subject to protection by intellectual or industrial property legislation, which are accessible on the Portal correspond exclusively to FREMAP and all rights over them are expressly reserved.

  The creation of hypertext links to any element of the Portal's web pages is prohibited without the express authorisation of FREMAP. In any case, the Portal reserves all rights over the content, information, data and services it holds over the same. The Portal does not grant any licence or authorisation of use to the User for its content, data or services, other than that expressly described in these general conditions of use.

• These Specific Terms and Conditions of Use are governed entirely by Spanish law. For the resolution of any conflict relating to their interpretation or application, the User expressly submits to the Courts and Tribunals of Majadahonda (MADRID).
